By using our website and services, you agree to comply with and be bound by the following terms and conditions of use, which together with our Privacy Policy govern AppealSnap’s relationship with you in relation to this website and our services. If you disagree with any part of these terms and conditions, please do not use our website.

The Service is provided for informational and educational purposes only.
 AppealSnap does not provide legal, tax, or appraisal consulting services.
 AppealSnap does not represent users in any appeal or proceeding.
 Use of the Service does not create any agency, fiduciary, or advisory relationship.

Users are solely responsible for how they use the information provided.

3. Use of the Service

By accessing or using the Service, you agree to:

  • Use the Service only for lawful purposes and in accordance with these Terms.
  • Provide accurate, current, and complete information about yourself as prompted by the Service registration form.
  • Maintain the security of your password and identification.
  • Be responsible for all activities that occur under your account.
  • Acknowledge and agree to these terms and conditions by using the Service or being on the website.

4. User Responsibilities

You acknowledge and agree that you are solely responsible for:

  •  Filing your property tax protest (unless explicitly stated otherwise in your purchase)
  •  Meeting all deadlines 
  •  Verifying all data and information 
  •  Presenting evidence to the appraisal district 
  •  Any outcomes resulting from your appeal 

AppealSnap is not responsible for outcomes resulting from user actions, inactions, or misuse of the Service.

5. Privacy

Your use of the Service is also subject to our Privacy Policy. By using the Service, you consent to the collection and use of your information as outlined in the Privacy Policy.

6. User Data

  • The Service collects and uses your email address and name to deliver property value appeal evidence to you.
  • We will not sell, distribute, or lease your personal information to third parties unless we have your permission or are required by law to do so.

7. Intellectual Property

  • The Service and its original content, features, and functionality are and will remain the exclusive property of AppealSnap and its licensors.
  • The Service, logo, and business name of AppealSnap is protected by copyright, trademark, and other laws of both the United States and foreign countries.
  • Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AppealSnap.
  • You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only.
  • You may not reproduce, distribute, or commercially exploit any portion of the Service without prior written consent.

8. Notice of Harm and Waiver of Claims

  • In the event that you experience any harm following your use of the Service, you must provide written notice to AppealSnap no later than 30 days after the discovery of the event causing such harm.
  •  Failure to provide such notice within this 30-day period will result in a waiver of any claims you may have against AppealSnap related to the event of harm, to the fullest extent permitted by applicable law

9. Termination

 We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. 

10. Limitation of Liability

In no event shall AppealSnap, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.  To the maximum extent permitted by law, AppealSnap’s total liability arising out of or relating to the Service shall not exceed the amount paid by you to AppealSnap for the Service. 

11. Third-Party Services

  • The Service may include links to third-party websites or services that are not owned or controlled by AppealSnap.
  • AppealSnap has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
  •  AppealSnap assumes no responsibility for third-party content, policies, or practices. 
  • You further acknowledge and agree that AppealSnap shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
  • We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

12. Data Security

AppealSnap takes reasonable measures to protect your information from unauthorized access or disclosure.

However, no method of transmission or storage is completely secure. AppealSnap shall not be liable for unauthorized access except in cases of gross negligence or willful misconduct.

13. Disclaimers and No Guarantees

  • AppealSnap makes no warranties or guarantees concerning the results that may be obtained from the use of the Service.
  • Specifically, results from property value appeals cannot be guaranteed.
  • AppealSnap does not guarantee reduction to property value, any tax savings, or the success of any appeal.
  • The Service is provided on an "as is" and "as available" basis. Use of the Service is at your own risk.
  • User acknowledges that even though AppealSnap is providing user with expert appeal evidence and property tax services, AppealSnap is not contracting to represent user in any appeal or claim as a property tax consultant or legal counsel.

14. Payments and Refunds

All fees are as displayed at the time of purchase.

Refunds are governed exclusively by the AppealSnap Money-Back Guarantee policy.

No refunds will be issued outside of that policy.

15. Indemnification

You agree to indemnify and hold harmless AppealSnap from any claims, damages, liabilities, or expenses arising from:

  •  Your use of the Service 
  •  Your violation of these Terms 
  •  Your misuse of any Content

16. Service Availability

The Service may be interrupted due to maintenance, updates, or unforeseen circumstances.

AppealSnap does not guarantee uninterrupted or error-free operation.

17. Force Majeure

AppealSnap shall not be liable for delays or failure to perform resulting from causes beyond its reasonable control, including but not limited to system outages, data provider failures, or governmental actions.

18. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of Arizona, United States.

All disputes shall be resolved in accordance with Section 20 (Dispute Resolution, Arbitration, and Class Action Waiver), except where court proceedings are expressly permitted. To the extent any dispute is permitted to be brought in court, such dispute shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona. 

19. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. 

20. Dispute Resolution, Arbitration, and Class Action Waiver

Agreement to Arbitrate

By using the Service, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved exclusively through binding arbitration, rather than in court, except as otherwise required by applicable law.

Arbitration shall be administered by a recognized arbitration provider and shall be filed and conducted in Maricopa County, Arizona, unless otherwise required by applicable law.

The parties agree that Maricopa County, Arizona shall be the exclusive venue for any arbitration proceeding arising out of or relating to these Terms.

Exceptions

Either party may bring a claim in small claims court if the claim qualifies.

AppealSnap may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information.

Class Action Waiver

To the fullest extent permitted by law, you agree that:

  •  You may bring claims against AppealSnap only in your individual capacity
  •  You waive any right to participate in a class action, collective action, or representative proceeding

No arbitration or proceeding shall be combined with another without the prior written consent of AppealSnap.

Waiver of Jury Trial

To the fullest extent permitted by law, you and AppealSnap waive any right to a trial by jury in any legal proceeding.

Opt-Out Right

You may opt out of this arbitration agreement by providing written notice to AppealSnap within 30 days of first using the Service.

Your notice must include:

  •  Your name 
  •  Email address 
  • Order number
  • Property for which the service was used
  •  A clear statement that you wish to opt out of arbitration 
  • Signature

If you opt out, you will still be bound by all other provisions of these Terms.
